What would happen?

I have been thinking. What would happen if you heard an argument and used a canon rebel eos lenses type of camera to record it.
If the people who were arguing did not give permission for the argument to be recorded, would it not have been admissible to court?
These days almost everyone has a phone that will record or photograph scenes. I have no idea what the legal processes are for something of that nature.
